Is It Surveying?

Presented by: Brian Naberezny, PLS

This presentation will review pertinent sections of Act 367, the Engineer, Land Surveyor and Geologist Registration Law along with portions of testimony from a hearing before the State Board of Professional Engineers, Land Surveyors, and Geologists. The hearing regards a company that offered to and actually provided an inventory of their client’s infrastructure by collecting attributes and GPS locations without the supervision of a licensed Professional Land Surveyor or Professional Engineer licensed in the Commonwealth of Pennsylvania. The results of the inventory were provided to the client in a GIS compatible format so it could be used in their newly implemented GIS mapping system. Attendees will have the opportunity to discuss whether or not this activity constitutes surveying based solely on the facts and testimony presented to the Board. Opportunities to protect the scope of practice will also be discussed.

About the Presenter: 

Mr. Naberezny is a self-employed consultant developing and implementing technological solutions for surveying and mapping applications and specializes in automating the collection, storage, retrieval, computation, processing, and analysis of spatial information.  Mr. Naberezny’s diverse work experience includes traditional boundary and land development surveying; software development for several Departments of Transportation; serving as a Geospatial Analyst and Operations Manager for a U.S. Department of Energy funded research project on the potential impacts of shale gas development on surface water quality; and teaching numerous surveying and mapping  courses and workshops at the undergraduate level as well as for practicing and aspiring professionals. 

Mr. Naberezny is a graduate of the Surveying Program at the Pennsylvania State University, received his M.S. in Spatial Information Science and Engineering from the University of Maine, and is a doctoral student in Civil Engineering with a Surveying emphasis at the University of Maine.  Mr. Naberezny is a licensed Professional Land Surveyor in the State of Maine and a certified Engineer-in-Training in the Commonwealth of Pennsylvania.  Mr. Naberezny serves on the Pennsylvania Society of Land Surveyors Board of Directors, Geospatial Committee, and Education Committee as well as on the Industrial Advisory Board for the Surveying Program at the Pennsylvania State University.
